2. Verarbeitung personenbezogener Daten und Zwecke der Verarbeitung

a) Beim Besuch der Webseite

Sie können die Webseite www.leichtbau.fraunhofer.de aufrufen, ohne Angaben zu Ihrer Identität preisgeben zu müssen. Der auf Ihrem Endgerät eingesetzte Browser sendet lediglich automatisch Informationen an den Server unserer Webseite (z.B. Browsertyp und –version, Datum und Uhrzeit des Zugriffs), um einen Verbindungsaufbau der Webseite zu ermöglichen. Hierzu gehört auch die IP-Adresse Ihres anfragenden Endgerätes. Diese wird temporär in einem sog. Logfile gespeichert und nach 4 Tagen automatisch gelöscht:

Die Verarbeitung der IP-Adresse erfolgt zu technischen und administrativen Zwecken des Verbindungsaufbaus und –stabilität, um die Sicherheit und Funktionsfähigkeit unserer Webseite zu gewährleisten und etwaige rechtswidrige Angriffe hierauf notfalls verfolgen zu können.

Die Rechtsgrundlage für die Verarbeitung der IP-Adresse ist Art. 6 Abs. 1 S. 1 lit. f DSGVO. Unser berechtigtes Interesse folgt aus dem erwähnten Sicherheitsinteresse und der Erforderlichkeit einer störungsfreien Bereitstellung unserer Webseite.

Aus der Verarbeitung der IP-Adresse und anderer Information in dem Logfile können wir keine unmittelbaren Rückschlüsse auf Ihre Identität ziehen.

Darüber hinaus setzen wir beim Besuch unserer Webseite Zählpixel sowie Analysedienste ein. Nähere Erläuterungen dazu erhalten Sie unter den Ziffer 4 dieser Datenschutzerklärung.

b) Bei Anmeldung für Veranstaltungen

Wir bieten regelmäßig Veranstaltungen verschiedenster Art über unsere Webseite an, für die Sie sich online anmelden können. Im Rahmen der Anmeldung für eine Veranstaltung müssen einige Pflichtangaben getätigt werden. Dazu gehören

Etwaige weitere Pflichtangaben sind als solche gekennzeichnet (z.B. mittels *). Zudem können oftmals freiwillig weitere Angaben getätigt werden.

Die Verarbeitung der Pflichtangaben erfolgt, um die Interessenten als Teilnehmer der Veranstaltung identifizieren zu können, sowie um den Vertrag über die Teilnahme abzuwickeln und die Teilnehmer vor, während und im Anschluss an die Veranstaltung mit Informationen zu der Veranstaltung zu versorgen. Die Angabe der freiwilligen Daten ermöglichen uns, die Veranstaltung interessen- und altersgerecht planen und durchführen zu können.

Die Datenverarbeitung erfolgt auf Anfrage der interessierten Teilnehmer und ist nach Art. 6 Abs. 1 S. 1 lit. b DSGVO zu den genannten Zwecken für die Erfüllung des Teilnehmervertrages und den vorvertraglichen Maßnahmen erforderlich.

Die für die Veranstaltung von uns erhobenen personenbezogenen Daten werden bis zum Ablauf von 6 Monaten gespeichert, soweit Sie nicht in eine darüber hinausgehende Speicherung nach Art. 6 Abs. 1 S. 1 lit. a DSGVO eingewilligt haben.

Im Rahmen der Veranstaltungsanmeldung über unsere Webformulare arbeiten wir mit dem Dienstleister Mailingwork GmbH, Birkenweg 7, 09569 Oederan (»Mailingwork«) zusammen. Zweck der Zusammenarbeit ist die professionelle Verwaltung von Online-Anmeldungen. Dazu werden die eingegebenen Daten auf den Servern von Mailingwork in Deutschland gespeichert.

Wir haben mit Mailingwork einen Auftragsverarbeitungsvertrag abgeschlossen. Durch diesen Vertrag versichert Mailingwork, dass sie die Daten in unserem Auftrag im Einklang mit der Datenschutzgrundverordnung verarbeiten und den Schutz der Rechte der betroffenen Personen gewährleisten.

Darüber hinaus kann es im Rahmen der Vertragserfüllung erforderlich sein, dass Ihre personenbezogenen Daten an einen externen Veranstalter übermittelt werden müssen. Im Zusammenhang mit einer Veranstaltungsanmeldung werden Sie in einem solchen Fall darüber informiert, wer Veranstalter ist und ob es sich dabei um einen externen Veranstalter handelt. Dieser wird personenbezogenen Daten im Rahmen der Veranstaltung und insbesondere zur Teilnehmerverwaltung verarbeiten.

3. Weitergabe von personenbezogenen Daten an Dritte

Außer in den zuvor genannten Fällen (Anmeldung für Veranstaltungen) geben wir Ihre personenbezogenen Daten nur an Dritte weiter, wenn:

Sie gem. Art. 6 Abs. 1 S. 1 lit. a DSGVO Ihre ausdrückliche Einwilligung dazu erteilt haben,
dies gem. Art. 6 Abs. 1 S. 1 lit. b DSGVO für die Erfüllung eines Vertrages mit Ihnen erforderlich ist,
für den Fall, dass für die Weitergabe nach Art. 6 Abs. 1 S. 1 lit. c DSGVO eine gesetzliche Verpflichtung besteht.

Falls eine Übermittlung von personenbezogenen Daten an ein Drittland (außerhalb der EU) oder eine internationale Organisation erfolgt, wird dies gesondert ausgeschlossen.

4. Webanalyse mittels Leadlab (Wiredminds GmbH)

Wir setzen auf unserer Webseite den Dienst Leadlab von der Wiredminds GmbH und deren Zählpixeltechnologie zur Analyse des Nutzungsverhaltens und zur darauf basierenden Optimierung unserer Seite ein. Insbesondere erlaubt uns der Dienst zu erkennen, welche Unternehmen unsere Seite besucht haben. Dabei erhalten wir keine Informationen, die Sie unmittelbar identifizieren.

Im Zusammenhang mit dem Einsatz von Leadlab werden Zählpixel eingesetzt, die eine statistische Analyse der Nutzung dieser Website durch Ihre Besuche ermöglichen. Die Informationen werden von Wiredminds unter Verwendung eines Pseudonyms in einem Nutzungsprofil zum Zwecke der Analyse verarbeitet und möglichst anonymisiert.

Die dabei gewonnenen Daten werden ohne Ihre gesondert erteilte Zustimmung nicht benutzt, um Sie persönlich zu identifizieren und die Daten werden nicht mit personenbezogenen Daten über Sie als Träger des Pseudonyms zusammengeführt.

Soweit IP-Adressen erhoben werden, werden diese unverzüglich nach Erhebung durch Löschen des letzten Nummernblocks anonymisiert.

Die Datenverarbeitung erfolgt auf Grund unseres berechtigten Interesses gemäß Art. 6 Abs.1 lit. f DSGVO an der Optimierung unseres Online-Angebotes und unseres Webauftritts. Wiredminds verarbeitet die Daten in unserem Auftrag und wir haben einen Auftragsverarbeitungsvertrag mit Wiredminds abgeschlossen. Dieser stellt sicher, dass die Datenverarbeitung in unserem Auftrag im Einklang mit der Datenschutzgrundverordnung erfolgt und den Schutz der Rechte der betroffenen Personen gewährleistet.

5. Social Plugins

Wir setzen auf unserer Webseite sog. Social-Media-Buttons (auch Social-Media-Plugins) ein. Hierbei handelt es sich um kleine Schaltflächen mittels derer Sie Inhalte unserer Webseite in sozialen Netzwerken unter Ihrem Profil veröffentlichen können.

Sofern Sie eine solche Schaltfläche aktivieren, wird eine Verbindung zwischen unserer Webseite und dem sozialen Netzwerk hergestellt. Neben den betreffenden Inhalten, erhält der Betreiber des sozialen Netzwerkes weitere zum Teil personenbezogene Information. Dazu gehört etwa der Umstand, dass Sie gerade unsere Seite besuchen.

Die Einbindung der Social-Media-Buttons erfolgt unter Einsatz der sog. Shariff-Lösung. Diese von Heise und c’t entwickelte Lösung verhindert, dass bereits eine Verbindung zu einem sozialen Netzwerk aufgebaut wird, nur weil Sie eine Seite mit einem Social-Media-Button aufrufen, ohne diesen zu aktivieren. Das bedeutet, dass erst dann Informationen an das soziale Netzwerk übermittelt werden, wenn Sie die Schaltfläche einsetzen.

Die folgenden Social-Media-Plugins setzen wir ein:

a) Facebook: Teilen der Facebook Ireland Limited

Teilweise werden Informationen an die Muttergesellschaft Facebook Inc. mit Sitz in den USA, an andere Facebook-Unternehmen und an externe Partner von Facebook übermittelt, die sich jeweils außerhalb der Europäischen Union befinden können. Facebook verwendet dafür von der Europäischen Kommission genehmigte Standardvertragsklauseln und verlässt sich auf die von der Europäischen Kommission erlassenen Angemessenheitsbeschlüsse bezüglich bestimmter Länder.
Zweck und Umfang der Datenerhebung und die weitere Verarbeitung und Nutzung der Daten durch Facebook sowie Ihre diesbezüglichen Rechte und Einstellungsmöglichkeiten zum Schutz Ihrer Privatsphäre entnehmen Sie bitte den Datenschutzhinweisen von Facebook.

b) Twitter: Teilen der Twitter International Company

Teilweise werden Informationen an die Muttergesellschaft Twitter Inc. mit Sitz in den USA, an andere Twitter-Unternehmen und an externe Partner von Twitter übermittelt, die sich jeweils außerhalb der Europäischen Union befinden können. Twitter verwendet dafür von der Europäischen Kommission genehmigte Standardvertragsklauseln und verlässt sich auf Ihre Einwilligung.

c) NEW WORK SE (früher XING SE): Teilen der Xing SE

Teilweise werden Informationen an andere NEW WORK-Unternehmen und an externe Partner von NEW WORK übermittelt, die sich jeweils außerhalb der Europäischen Union befinden können. NEW WORK verwendet dafür von der Europäischen Kommission genehmigte Standardvertragsklauseln oder andere gem. Art. 46 DSGVO geeignete Garantien und verlässt sich auf die von der Europäischen Kommission erlassenen Angemessenheitsbeschlüsse bezüglich bestimmter Länder sowie Ihre Einwilligung.

d) LinkedIn: Teilen der LinkedIn Unlimited Company

Teilweise werden Informationen an die Muttergesellschaft LinkedIn Corporation mit Sitz in den USA, an andere LinkedIn-Unternehmen und an externe Partner von LinkedIn übermittelt, die sich jeweils außerhalb der Europäischen Union befinden können. LinkedIn verwendet dafür von der Europäischen Kommission genehmigte Standardvertragsklauseln.

6. Betroffenenrechte

Sie haben das Recht:

gemäß Art. 7 Abs. 3 DSGVO Ihre einmal erteilte Einwilligung jederzeit gegenüber uns zu widerrufen. Dies hat zur Folge, dass wir die Datenverarbeitung, die auf dieser Einwilligung beruhte, für die Zukunft nicht mehr fortführen dürfen;
gemäß Art. 15 DSGVO Auskunft über Ihre von uns verarbeiteten personenbezogenen Daten zu verlangen. Insbesondere können Sie Auskunft über die Verarbeitungszwecke, die Kategorie der personenbezogenen Daten, die Kategorien von Empfängern, gegenüber denen Ihre Daten offengelegt wurden oder werden, die geplante Speicherdauer, das Bestehen eines Rechts auf Berichtigung, Löschung, Einschränkung der Verarbeitung oder Widerspruch, das Bestehen eines Beschwerderechts, die Herkunft ihrer Daten, sofern diese nicht bei uns erhoben wurden, sowie über das Bestehen einer automatisierten Entscheidungsfindung einschließlich Profiling und ggf. aussagekräftigen Informationen zu deren Einzelheiten verlangen;

gemäß Art. 18 DSGVO die Einschränkung der Verarbeitung Ihrer personenbezogenen Daten zu verlangen, soweit die Richtigkeit der Daten von Ihnen bestritten wird, die Verarbeitung unrechtmäßig ist, Sie aber deren Löschung ablehnen und wir die Daten nicht mehr benötigen, Sie jedoch diese zur Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen benötigen oder Sie gemäß Art. 21 DSGVO Widerspruch gegen die Verarbeitung eingelegt haben;
gemäß Art. 20 DSGVO Ihre personenbezogenen Daten, die Sie uns bereitgestellt haben, in einem strukturierten, gängigen und maschinenlesebaren Format zu erhalten oder die Übermittlung an einen anderen Verantwortlichen zu verlangen und
gemäß Art. 77 DSGVO sich bei einer Aufsichtsbehörde zu beschweren. In der Regel können Sie sich hierfür an die Aufsichtsbehörde ihres üblichen Aufenthaltsortes oder Arbeitsplatzes oder unseres Unternehmenssitzes wenden.

7. Information über Ihr Widerspruchsrecht nach Art. 21 DSGVO

Sie haben das Recht, aus Gründen, die sich aus Ihrer besonderen Situation ergeben, jederzeit gegen die Verarbeitung Sie betreffender personenbezogener Daten, die aufgrund von Artikel 6 Absatz 1 Buchstabe e DSGVO (Datenverarbeitung im öffentlichen Interesse) und Artikel 6 Absatz 1 Buchstabe f DSGVO (Datenverarbeitung auf der Grundlage einer Interessenabwägung) erfolgt, Widerspruch einzulegen; dies gilt auch für ein auf diese Bestimmung gestütztes Profiling von Artikel 4 Nr. 4 DSGVO.

Legen Sie Widerspruch ein, werden wir Ihre personenbezogenen Daten nicht mehr verarbeiten, es sei denn, wir können zwingende schutzwürdige Gründe für die Verarbeitung nachweisen, die Ihre Interessen, Rechte und Freiheiten überwiegen, oder die Verarbeitung dient der Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen.

Sofern sich Ihr Widerspruch gegen eine Verarbeitung von Daten zum Zwecke der Direktwerbung richtet, so werden wir die Verarbeitung umgehend einstellen. In diesem Fall ist die Angabe einer besonderen Situation nicht erforderlich. Dies gilt auch für das Profiling, soweit es mit solcher Direktwerbung in Verbindung steht.

8. Datensicherheit

Alle von Ihnen persönlich übermittelten Daten werden mit dem allgemein üblichen und sicheren Standard TLS (Transport Layer Security) verschlüsselt übertragen. TLS ist ein sicherer und erprobter Standard, der z.B. auch beim Onlinebanking Verwendung findet. Sie erkennen eine sichere TLS-Verbindung unter anderem an dem angehängten s am http (also https://..) in der Adressleiste Ihres Browsers oder am Schloss-Symbol im unteren Bereich Ihres Browsers.

2. Personal Data Processing and Purposes of Data Processing

a) When visiting the website

You may access our website without having to disclose any details of your identity. The browser installed on your terminal device automatically transmits information to the server of our website (e.g. browser type and version, date and time of access) to enable connection with the website, including the IP address of your requesting terminal device. This information is temporarily stored in a so-called log file and deleted after 4 days.
Your IP address is processed for technical and administrative purposes regarding connection set-up and stability, to guarantee the security and functioning of our website and to be able to track any illegal attacks on the website, if required.
The legal basis for processing the IP address is Art. 6 (1) lit. f GDPR. Our legitimate interest ensues from said security interest and the necessity of the unobstructed availability of our website.
We cannot draw any direct conclusions about your identity from processing the IP address and other information in the log file.

b) When registering for events

We offer a variety of events through our website on a regular basis, for which you may register online.
In order to register online, our website’s visitors have to provide some mandatory data, which generally include:
•   First and last name
•   Address
•   Email address
•   Payment information (only for events that require payment and depending on the selected method of payment)
Any other mandatory data are marked as such (e.g. with *). Further information can often be provided voluntarily.
The purpose of processing the mandatory data is to identify you as event participant, to reserve a spot for your participation, to establish a contractual relationship with you, to provide you before, during and after the event with information that will optimize your participation, and to help us plan and ensure a smooth event experience. If we collect your payment information for events that require payment, the data are needed to process the participation fee. Voluntary data allow us to plan and conduct the event based on participant interest.
We process data at your request and for the purposes described by Article 6 (1) lit. b GDPR to fulfill the obligations of the participation agreement and precontractual conditions.
We store the data we collect in the context of event registrations for 6 months unless you have consented to a longer storage period under Art. 6 (1) lit. a GDPR.
To accept event registrations from our online visitors, we have commissioned the service provider Mailingwork GmbH, Birkenweg 7, 09569 Oederan (»Mailingwork«). The purpose of working with the service provider is the professional management of online registrations. This service requires storing the collected data on the servers of Mailingwork in Germany.
We have entered into a data processing agreement with Mailingwork. By signing this contract with us, Mailingwork agrees to process the data on our behalf pursuant to the General Data Protection Regulation (GDPR) and to ensure that the rights of the data subjects are protected.
Photos and videos will be taken to document the event in pictures. Since you can possibly be identified in these images, either directly or indirectly, they represent personal data.
The images are created for Fraunhofer and will be used for news reporting directly associated with the event as well as for internal and external reporting by Fraunhofer.
Furthermore, the images will be published for the purpose of subsequent news reporting on our media platforms such as Facebook and Instagram or our website. This processing is required in particular to document our event and promote future events.
The legal basis for data processing is Art. 6 (1) lit. f GDPR. The purposes mentioned are legitimate interests within the meaning of the aforementioned provision.
The images will be stored for 3 years.

c) When subscribing to a newsletter or other email list

Once you have given your explicit consent pursuant to Art. 6 (1) lit. a GDPR, we will use your email address to regularly send you selected information about the work in our Institute and/or on other facilities and/or events of the Fraunhofer-Gesellschaft. The subjects and contents of the selected information are determined by the list you subscribed to.
To receive our newsletter, we ask you to provide us with the following mandatory data:
•   Email address
•   Title
•   First name
•   Last name
We need your name and title to address you personally in our newsletter.
You may voluntarily provide additional personal data (e.g. address and telephone number). We use this data to contact you by telephone or mail (e.g. for press invitations).
Once you have subscribed, you will receive a registration notification by email, which you need to confirm to receive the newsletter (so-called double opt-in). Your email response serves as confirmation that you are in fact the person who issued the subscription.

Once we have received your cancellation of the newsletter subscription, we will immediately delete your email address.
Our service provider, Mailingwork GmbH, Birkenweg 7, 09569 Oederan (»Mailingwork«), sends our newsletter to your email address on our behalf. Mailingwork stores the email addresses of our newsletter recipients on their servers in Germany on our behalf.
Mailingwork uses this information for the purpose of sending and evaluating newsletters on our behalf. For this purpose, we entered into a data processing agreement with Mailingwork. By signing this agreement, Mailingwork undertakes to process the subscriber data in compliance with the General Data Protection Regulation (GDPR) and to uphold the rights of all data subjects.
Mailingwork has assured us that personal data are extensively protected from unauthorized access. Mailingwork is barred from using the data provided by our newsletter subscribers to contact the subscribers itself and is not authorized to transfer the subscriber data to third parties. As a reputable email sending service, Mailingwork is also certified by the Certified Senders Alliance.

d) When using contact forms

We offer the option to contact us via a contact form provided on the website. This involves the following mandatory information:
•   Title
•   First and last name
•   Email address.

We require your data to determine who sent the inquiry and to be able to answer and process it.
This data processing in response to your inquiry is necessary for the purposes of our legitimate interests pursuant to Art. 6 (1) lit. f GDPR.
We will delete the personal data collected by us using the contact form after your inquiry has been processed.

3. Transfer of Data

If we forward personal data collected through websites to processors, we will notify you in this data protection information regarding the respective data processing operation, citing the specific recipient.
Aside from that, we will only forward your personal data if
•   you have given consent pursuant to Art. 6 (1) lit. a GDPR;
•   this is required pursuant to Article 6 (1) lit. b GDPR for the performance of a contract with you (for example forwarding to shipping companies for the purpose of delivering goods ordered by you, or forwarding payment information to payment service providers or credit institutions in order to process a payment transaction);
•   there is a legal obligation for disclosure pursuant to Art. 6 (1) lit. c GDPR.

Our website uses the Leadlab service by Wiredminds GmbH and its tracking pixel technology to analyze user behavior and optimize our site accordingly. The service particularly allows us to identify which companies have visited our site. In so doing we do not obtain any information that may identify you directly.
The use of Leadlab involves cookies and tracking pixels which allow statistical analysis of the use of this website based on your visits. Information, including personal information, about your visiting behavior is stored in the cookie and sent to Wiredminds or is directly obtained by Wiredminds. Wiredminds uses a pseudonym to process the information in a usage profile for the purpose of analysis. The data are anonymized to the extent possible.
Without your specific permission, we neither use the data collected to identify you personally nor will we match the data with personal data pertaining to the pseudonym associated with you.
If IP addresses are collected, they are immediately anonymized after collection by deleting the last number block.

We process statistical data based on our legitimate interest pursuant to Article 6 (1) lit. f GDPR for optimizing our online offering and our web presence. Wiredminds processes the data on our behalf based on a data processing agreement between us and Wiredminds. This agreement ensures that the data processing on our behalf is consistent with the General Data Protection Regulation and guarantees the protection of the data subjects’ rights.
If you do not want your usage behavior to be recorded and analyzed, you may object by means of an opt-out cookie. It will be set to prevent the future collection of your data when you visit this website. The opt-out cookie works only in this browser and only for our website. It is stored on your device. If you delete the cookies for this browser, you will have to set the opt-out cookie again.

We use so-called social media buttons (also called social media plug-ins) on our website. These are small icons which you can use to share the contents of our website in your profile on social networks.

We integrate components (videos) of YouTube, LLC, 901 Cherry Ave., 94066 San Bruno, CA, USA (hereinafter “YouTube”), a company of Google Inc., Amphitheatre Parkway, Mountain View CA 94043, USA, (hereinafter “Google”) in our websites. The implementation is based on Art. 6 (1) lit. f GDPR; our legitimate interest in that case is the smooth integration of the videos and the attractive design of our website.
Our websites use a solution that prevents the establishment of a connection to Google simply because you visit a site with an integrated video, without activating the video. This means that information is transmitted to YouTube only if you actually click to view the video.
Google complies with the Data Protection Regulations of the U.S. Privacy Shield and is registered with the U.S. Privacy Shield Program of the U.S. Department of Trade.

In particular, you may request information about the purposes of the processing, the categories of personal data concerned, the categories of recipients to whom the personal data have been or will be disclosed, and the envisaged period for which the data will be stored. Moreover, you have the right to request rectification, erasure, or restriction of processing, to object to processing, the right to lodge a complaint, and to obtain information about the source of your data if they were not collected by us, as well as about the existence of automated decision-making, including profiling, and, if applicable, meaningful information about the logic involved;
•   pursuant to Art. 16 GDPR, to obtain the rectification of inaccurate data or the completion of your personal data without undue delay;

You have the right to object, on grounds relating to your particular situation, at any time to processing of your personal data pursuant to Art. 6 (1) lit. e GDPR (data processing carried out in the public interest) and Art. 6 (1) lit. f GDPR (data processing for purposes of legitimate interests).
If you file an objection, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for processing which override your interests, rights and freedoms, or unless the processing serves the establishment, exercise or defense of legal claims.
If your objection is directed against the processing of data for the purpose of direct marketing, we will stop the processing immediately. In this case, citing a special situation is not necessary. This includes profiling to the extent that it is related to such direct marketing.
